1. Agreement to Terms

These Terms of Service ("Terms") constitute a legally binding agreement between you and BuyMyFlightPass ("we," "our," or "us") governing your access to and use of the buymyflightpass.net website and our private travel facilitation and concierge services (collectively, the "Service").

By accessing or using our Service, you agree to be bound by these Terms. If you disagree with any part of these Terms, you may not access or use our Service. We recommend that you print or save a copy of these Terms for your records.

2. Description of Services

BuyMyFlightPass is a premium concierge and matchmaking service that introduces travelers to verified airline employees who may choose, at their sole discretion, to designate you as their companion for travel benefits. Our services include:

• Introducing users to private individuals who, at their sole discretion and subject to airline rules, may facilitate standby travel access
• Facilitating the application and onboarding process
• Coordinating contract execution through electronic signature
• Processing payments for facilitation, coordination, and concierge services
• Providing customer support throughout the companion pass period

3. Assumption of Risk

By using our Service, you acknowledge and accept the following risks:

• Standby Travel Uncertainty: Companion pass travel is standby-only. You may not get a seat on any particular flight, and flight availability is never guaranteed.
• Policy Changes: Airlines may modify, suspend, or terminate companion pass programs or employee benefits at any time without notice.
• Denied Boarding: Airlines have sole discretion over boarding decisions. You may be denied boarding for any reason, including but not limited to: full flights, dress code violations, behavior, or airline policy changes.
• Benefit Revocation: Airline employee benefits may be revoked by the airline at any time, which could affect your access to companion pass privileges.
• Travel Disruptions: Standby travel carries inherent risks including missed connections, extended layovers, and inability to reach your destination on your preferred timeline.

YOU EXPRESSLY ASSUME ALL RISKS ASSOCIATED WITH STANDBY TRAVEL AND COMPANION PASS USE. We strongly recommend maintaining flexible travel plans and having backup arrangements when using companion pass benefits.

4. Eligibility

To use our Service, you must:

• Be at least 18 years of age
• Be legally capable of entering into binding contracts
• Provide accurate and complete personal information
• Have a valid email address and phone number
• Comply with all applicable airline policies and regulations

By using our Service, you represent and warrant that you meet all eligibility requirements.

5. Service Terms and Conditions

5.1 Companion Pass Benefits

• Companion pass access provides standby travel privileges only
• The companion pass benefit period is typically 12 months from activation
• Seat availability is subject to airline policies and flight capacity
• You are responsible for all applicable taxes, fees, and charges for each flight
• Boarding priority is determined by airline policies and is not guaranteed

5.2 No Guarantee of Travel

Standby travel means you may not be able to board every flight you attempt. We do not guarantee:

• Specific flight availability or confirmation
• Seat assignments or upgrades
• Travel on specific dates or times
• Access to all routes or destinations

5.3 Airline Policy Compliance

You must comply with all airline dress codes, behavior policies, and travel regulations. Airlines reserve the right to deny boarding at their discretion. We are not responsible for any actions taken by airlines.

6. Payment Terms

Payment for our services is due upon completion of the onboarding process. We accept various payment methods including credit/debit cards, wire transfers, and other approved methods.

6.1 Payment Processing

All credit/debit card payments are processed securely through Square, a PCI-compliant payment processor. By providing payment information, you authorize us to charge the specified amount.

6.2 Refund Policy

• Before Activation: Refund requests submitted before access has been confirmed by the third party will be reviewed on a case-by-case basis
• After Activation: Fees are non-refundable once access has been confirmed by the third party
• Service Issues: If we are unable to fulfill our service obligations, we will work with you to find a resolution, which may include a partial or full refund

6.3 Chargebacks

If you initiate a chargeback or payment dispute, we reserve the right to suspend or terminate your companion pass access and take appropriate legal action.

7. User Responsibilities

By using our Service, you agree to:

• Provide accurate, complete, and current personal information
• Promptly update your information if it changes
• Respond to communications from us in a timely manner
• Comply with all applicable laws and airline policies
• Use the companion pass benefits only for personal travel
• Not resell, transfer, or share your companion pass access with others
• Maintain appropriate conduct during all airline travel
• Not engage in any fraudulent or misleading activities

Users acknowledge that they are solely responsible for ensuring their use of any travel access complies with airline policies and employment rules applicable to the third party.

8. Communications

By providing your contact information, you consent to receive communications from us via:

• Email: Service updates, application status, important notices, and marketing (if opted-in)
• SMS/Text Messages: Application alerts, appointment reminders, and service notifications
• Phone Calls: For consultation, support, and verification purposes

You may opt-out of marketing communications at any time. Service-related communications are necessary for the fulfillment of our services and may not be opted out of while using our Service.

9. Intellectual Property

All content on our website, including but not limited to text, graphics, logos, images, audio clips, digital downloads, and software, is the property of BuyMyFlightPass or its content suppliers and is protected by United States and international intellectual property laws.

You may not reproduce, distribute, modify, create derivative works of, publicly display, publicly perform, republish, download, store, or transmit any of the material on our website without our prior written consent.

10. Disclaimer of Warranties

OUR SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that:

• The Service will be uninterrupted, timely, secure, or error-free
• The results obtained from using the Service will be accurate or reliable
• You will be able to board any specific flight or travel on any specific date
• Airline policies will not change during your companion pass period

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL BUYMYFLIGHTPASS, ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, OR AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION:

• Loss of profits, revenue, or business opportunities
• Loss of data or goodwill
• Cost of substitute services
• Personal injury or property damage
• Missed flights, travel delays, or related expenses
• Any other intangible losses

Our total liability for any claims arising under these Terms shall not exceed the amount you paid for our services.

12. Indemnification

You agree to indemnify, defend, and hold harmless BuyMyFlightPass and its officers, directors, employees, agents, and affiliates from and against any and all claims, damages, obligations, losses, liabilities, costs, and expenses arising from:

• Your use of the Service
• Your violation of these Terms
• Your violation of any third-party rights
• Your violation of any applicable laws or regulations
• Any content you submit or transmit through the Service

13. Termination

We reserve the right to terminate or suspend your access to our Service immediately, without prior notice or liability, for any reason, including but not limited to:

• Breach of these Terms
• Fraudulent or illegal activity
• Failure to make required payments
• Providing false or misleading information
• Violation of airline policies that affects the companion pass arrangement

Upon termination, your right to use the Service will immediately cease. All provisions of these Terms which by their nature should survive termination shall survive.

14. Dispute Resolution

14.1 Informal Resolution

Before filing any formal dispute, you agree to contact us at hello@buymyflightpass.net and attempt to resolve the dispute informally for at least 30 days.

14.2 Arbitration

Any disputes that cannot be resolved informally shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association. The arbitration shall be conducted in English and the arbitrator's decision shall be final and binding.

14.3 Class Action Waiver

YOU AGREE THAT ANY DISPUTE RESOLUTION PROCEEDINGS WILL BE CONDUCTED ONLY ON AN INDIVIDUAL BASIS AND NOT IN A CLASS, CONSOLIDATED, OR REPRESENTATIVE ACTION.

15. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of California, United States, without regard to its conflict of law provisions. You agree to submit to the personal and exclusive jurisdiction of the courts located in California.

16. Severability

If any provision of these Terms is held to be unenforceable or invalid, such provision will be changed and interpreted to accomplish the objectives of such provision to the greatest extent possible under applicable law, and the remaining provisions will continue in full force and effect.

17. Entire Agreement

These Terms, together with our Privacy Policy and any other legal notices published by us, constitute the entire agreement between you and BuyMyFlightPass regarding your use of the Service and supersede all prior and contemporaneous written or oral agreements.

18. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify users of any material changes by posting the updated Terms on our website and updating the "Last updated" date. Your continued use of our Service after such changes constitutes acceptance of the new Terms.
